These Terms of Service ("Terms") govern your access to and use of LearnIT, an independent, multi-sensory study platform for professional licensure exam preparation (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility & Account Registration
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. You agree to provide accurate registration information and to keep your password confidential.
2. Account Approval & Access
Every new account request is reviewed by LearnIT's root/master administrator before the account can sign in. Your account will be in a "pending" state after registration and you will not be able to access study content until it is approved. We may approve, deny, suspend, or revoke access to any account at our discretion, including for suspected abuse, fraud, or violation of these Terms or the Acceptable Use Policy.
3. Nature of the Service
LearnIT provides original study content -- visual diagrams, narrated audio, flashcards, question banks, and mock exams -- designed to reinforce concepts tested on professional licensure exams (currently the Florida 2-15 Life & Health Insurance exam, with additional subjects planned). LearnIT is a study aid only. See the Educational & Licensing Disclaimer for important limitations, which is incorporated into these Terms by reference.
4. Driving Mode
LearnIT offers an optional, audio-first "Driving Mode" intended strictly for hands-free, eyes-free listening. Use of Driving Mode is subject to the Driving Mode Safety Policy, which is incorporated into these Terms by reference and which you must acknowledge each time you use the feature. You are solely responsible for complying with all traffic, distracted-driving, and hands-free-device laws applicable to you, and for operating any vehicle safely at all times.
5. Acceptable Use
You agree to use the Service only as permitted by these Terms and the Acceptable Use Policy, which is incorporated into these Terms by reference.
6. Fees
The Service is currently offered free of charge. LearnIT may introduce optional premium tiers or paid features in the future; if it does, pricing and billing terms will be presented and agreed to separately before any charge is made.
7. Intellectual Property
All study content, software, designs, audio narration, and trademarks associated with LearnIT are owned by LearnIT/ApeXhit or its licensors. You may use them only for your personal, non-commercial exam-preparation purposes. You may not copy, redistribute, resell, or create derivative works from the Service's content without prior written permission.
8. No Professional Advice; No Guarantee
LearnIT does not guarantee that use of the Service will result in passing any licensing exam or obtaining any license. Nothing in the Service constitutes legal, insurance, financial, or professional advice.
9. Termination
You may stop using the Service and request account deletion at any time by contacting support. We may suspend or terminate your account for violation of these Terms, the Acceptable Use Policy, or the Driving Mode Safety Policy, or for any conduct we reasonably believe is harmful to the Service or other users.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. Licensure exam content, regulator names, and statutory requirements change over time; while we make reasonable efforts to keep content current, you should verify time-sensitive requirements with your state's official Department of Insurance (or equivalent) or testing vendor.
11. Limitation of Liability
To the maximum extent permitted by law, LearnIT and its owners, contributors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including damages for failure to pass an exam, loss of data, or personal injury (including injury arising from use of the Service while operating a vehicle in violation of the Driving Mode Safety Policy), arising out of or related to your use of the Service.
12. Indemnification
You agree to indemnify and hold harmless LearnIT and its owners and contributors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, the Acceptable Use Policy, the Driving Mode Safety Policy, or applicable law.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will update the "last updated" date shown on this page and, where appropriate, will require renewed acceptance. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles, unless a different governing law is required by the mandatory law of your jurisdiction of residence.
