Driving Mode Safety Policy

Driving Mode is an optional, audio-first experience designed to be used hands-free and eyes-free -- for listening only, never for reading or manually operating a device while a vehicle is in motion. This policy describes the safety rules that apply every time Driving Mode is used, and you must acknowledge it before each Driving Mode session.

Mandatory safety rules

  • Never look at, hold, or manually operate your phone or this app while your vehicle is in motion. Distracted driving is illegal in most jurisdictions and is a leading cause of traffic crashes and fatalities.
  • Set up Driving Mode -- choose podcasts or flashcards, and start playback -- BEFORE you begin driving, while your vehicle is safely parked.
  • Use Driving Mode only in a hands-free, audio-only manner while the vehicle is moving. Do not attempt to read on-screen text or tap controls while driving.
  • If you need to pause, skip, go back, or make any other adjustment, pull over to a safe and legal location and come to a complete stop first.
  • Comply with all federal, state, and local laws regarding distracted driving and hands-free device use, which vary by jurisdiction and may be stricter than this policy.
  • If a passenger is present, let the passenger operate the app if any manual interaction is genuinely necessary while the vehicle is moving.
  • Exit or silence Driving Mode entirely, and give your full attention to the road, whenever traffic, weather, or road conditions demand it.
  • In an emergency, or if you are unsure whether it is safe to continue, stop using the Service immediately and focus on operating your vehicle safely.

Acknowledgment required each session

Because these rules are safety-critical, LearnIT requires you to affirmatively acknowledge this policy before each Driving Mode session (once per browser session). Acknowledgment is logged with a timestamp for accountability. Declining to acknowledge will exit you back out of Driving Mode.

Assumption of risk

You use Driving Mode entirely at your own risk. You, and not LearnIT, are solely responsible for operating any vehicle safely and lawfully at all times. LearnIT disclaims all liability for any injury, death, property damage, citation, or other loss arising from use of the Service while operating a vehicle, to the maximum extent permitted by law, as further described in the Terms of Service.

Reporting a safety concern

If you encounter a bug, confusing control, or any other issue that could compromise safe hands-free use, please report it to apexhit01@gmail.com so it can be addressed promptly.
